TERMS AND CONDITIONS OF SERVICE

These Terms and Conditions (the “Terms”) govern the contractual relationship between Evisa Travel Services S.L. (hereinafter, “MyTripVisa“), a Spanish entity with registered office at C/ Demetrio López 5, 5A, 28027 Madrid, Spain, and any individual or entity (the “Customer” or “User“) using our information and visa mediation services through the domains mytripvisa.com and its application subdomains (e.g., apply.mytripvisa.com).

 

1. NATURE OF THE SERVICE AND GOVERNMENT DISCLAIMER

1.1. Private Agency: MyTripVisa is a private administrative agency specialized in travel document mediation and logistics. We are NOT affiliated with, nor endorsed by, any government authority, embassy, or official department.

1.2. Independence: The Customer acknowledges that they are hiring a private mediation service. Official government websites are available for direct applications, often at a lower cost (only the government fee). By using our Services, the Customer chooses to pay an additional Service Fee for professional review, assistance, and technical processing.

1.3. Scope of Service: Our service consists of:

  • Providing up-to-date information regarding visa requirements and travel authorizations.
  • Reviewing, formatting, and preparing the Customer’s data and documentation to minimize errors.
  • Submitting the electronic application to the relevant government authorities through our secure technical platform (powered by our partner, Voyzo Inc.).
  • Providing real-time updates and delivering the final travel document.

 

2. PRICING AND PAYMENT STRUCTURE

2.1. Total Price: The total price displayed at checkout is a consolidated amount (“Bundle”) that consists of:

  • Government Fee: The official cost charged by the destination country’s government for the issuance of the visa or authorization.
  • Service Fee: Our professional fee for mediation, data review, technical platform maintenance, and 24/7 customer support.

2.2. Payment Processing: Evisa Travel Services S.L. (MyTripVisa) is the Merchant of Record and the legal entity responsible for the transaction. Payments are processed securely via third-party gateways (e.g., Square). The charge on the Customer’s credit or debit card statement will appear under the identifier “MyTripVisa”. By completing the payment, the Customer authorizes MyTripVisa to collect the total amount and its technical processor, Voyzo, to use the necessary portion of those funds to pay the government fees on the Customer’s behalf.

 

3. CANCELLATION AND REFUND POLICY

3.1. General Rule: Due to the nature of our services (personalized digital processing of administrative documents), the right of withdrawal is limited once the execution of the service has begun.

3.2. 100% Refund Eligibility: A full refund (100% of the total amount paid, including both Service Fee and Government Fee) will be granted ONLY if the Customer requests the cancellation BEFORE the application has been submitted to the relevant Government Authority.

3.3. Non-Refundable Stage: Once the application has been effectively transmitted to the government system and the official fee has been paid to the authorities, the service is considered “fully executed” or “in an advanced stage of execution” under Article 103 of the Spanish General Law for the Protection of Consumers (LGDCU). At this stage:

  • NO REFUNDS of the Service Fee will be issued.
  • NO REFUNDS of the Government Fee will be issued, as these funds have already been remitted to the destination country’s treasury and are non-recoverable.

3.4. Outcome Neutrality: The refund policy applies regardless of the government’s decision (Approval, Denial, or Delay).

 

4. ACCURACY OF INFORMATION AND CUSTOMER RESPONSIBILITY

4.1. Veracity: The Customer is solely responsible for providing accurate, complete, and truthful information.

4.2. Consequences of Errors: Any error in the data provided (e.g., passport number, expiration date, name spelling) may result in the immediate rejection of the visa or the invalidity of the document upon arrival at the destination.

4.3. No Liability for Consequential Losses: Under no circumstances shall MyTripVisa be liable for any indirect, incidental, or consequential costs or damages, including but not limited to missed flights, hotel bookings, land transportation, or any other travel-related expenses, regardless of whether such costs arise from incorrect information provided by the Customer, technical delays, or any other cause related to the service.

 

5. LIMITATION OF LIABILITY REGARDING GOVERNMENT ACTIONS

5.1. Sovereign Decision: MyTripVisa acts as a representative. The final decision to grant or deny a visa rests exclusively with the government of the destination country.

5.2. No Guarantees: We do not guarantee that a visa will be issued.

5.3. External Delays: We are not liable for delays caused by government system outages, additional administrative reviews, or changes in immigration policies.

5.4. Indirect Damages: MyTripVisa’s liability is strictly limited to the professional Service Fee paid by the Customer. We shall not be held responsible for any financial, business, or emotional loss, nor for any third-party costs (e.g., airline cancellation fees) resulting from the processing time, the final administrative decision, or any technical service interruption.

 

6. INTELLECTUAL PROPERTY AND TECHNOLOGY PARTNERS

6.1. Ownership: All content, branding, and software on mytripvisa.com and apply.mytripvisa.com are the exclusive property of MyTripVisa or its licensors.

6.2. Platform Provider: Our application portal is powered by Voyzo Inc. The Customer is granted a limited, non-transferable license to use this portal strictly for the purpose of submitting their personal visa application.

 

7. DATA PROTECTION

7.1. Roles: In accordance with the General Data Protection Regulation (EU) 2016/679:

  • Evisa Travel Services S.L. (MyTripVisa) acts as the Data Controller.
  • Voyzo Inc. acts as the Data Processor.

7.2. Processing Purpose: Your data is collected solely for the purpose of processing your travel authorization. Detailed information is available in our Privacy Policy.

7.3. Cross-Domain Consent: We use CookieYes technology to manage your privacy preferences. Consent given on our main domain is shared with our application subdomains to ensure a seamless and compliant user experience.

 

8. MODIFICATIONS

MyTripVisa reserves the right to modify these Terms at any time. The version applicable to a specific order is the one published at the time the Customer completes the payment.

 

9. GOVERNING LAW AND JURISDICTION

These Terms are governed by the Laws of Spain. For any dispute arising from these Terms, the parties submit to the jurisdiction of the courts of Madrid, Spain, except where consumer protection laws mandate the courts of the Customer’s domicile.
